EVENTS & WORKSHOPS BOOKING TERMS AND CONDITIONS

Definitions and Interpretation

The following terms shall have the following meanings:

“Client” means the person or persons, school or organisation to whom the Supplier has agreed to provide specified service in accordance with these Conditions.

“Contract” means the contract for the provision of the Specified Service as set out in the Specification and these Conditions.

“Damage Waiver” is an optional service, which if accepted reduces your liability for accidental damage to the Equipment.

"Equipment” any equipment provided by the Supplier for any Specified Service

“Specification” means the information providing details of each activity sent to the Client with these terms and condition or shown in the Clients booking area on the Suppliers website.

“Specified Service” means the service to be provided by the Supplier for the Client as set out in our correspondence.

“Supplier” means Beyond Creative Education Limited, 2-3 Station Yard, Ashburton, Devon, TQ13 7EF.

“Workshops” any Specified Services which are described as workshops in the Specification

The following terms and conditions apply to all persons and / or organisations or other entities (“you”) that are booking any workshop or event for young people, organised by Beyond Creative Education Limited (“we”, “us”). Please ensure you have read and understand the following:

1. Acceptance of terms and conditions

By booking a workshop by completion of the online booking form, or when booking by phone or email, you are agreeing to the terms and conditions set out below. You confirm that you have the relevant authority to book a workshop and authorise payment on behalf of your organisation or booking entity and you will ensure that your employees, colleagues, partners, agents, contractors, subcontractors and any other person or organisation attending the workshop on your behalf shall comply with these terms and conditions.

2. Payment

The fee for attending the workshop will be as stated on the booking form for the relevant workshop at the time of booking. It is also clearly advertised on our website. All payments for the workshop must be made at the time of booking.

3. Discounts and promotions utilising a promotional code

We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, workshop bookings.

Only one promotional discount code can be used per booking.
A promotional discount code can’t be used after an order has been placed.

We reserve the right to withdraw the use of promotional discount codes at any time at our own discretion.

A promotional discount code may have its own terms and conditions of use which will apply in addition to these terms and conditions.

Promotional discount codes shall not apply to rescheduled or cancelled bookings, and full payment of any fees due will be required regardless of any promotional discount applied. For the avoidance of doubt, in the instance where a workshop was booked using a promotional discount code offering a 100% discount but is cancelled less than 7 days prior to the date of the workshop, a fee equal to the full cost of the workshop will be due.

4. Cancellation by Beyond Creative Education Limited 

There may be circumstances in which we need to cancel a workshop. In such circumstances, we will offer alternative dates or alternative venues on which the workshop can be fulfilled. If you do not wish to accept the alternatives, which is entirely at your discretion, then we will provide you with a full refund of the amount that you have paid to us for the workshop and we will make every effort to provide you with such refund within 30 days of the date of cancellation. The refund shall not include any promotional discounts applied to your booking: you will only be refunded the net total that you paid to us.

Our sole liability in relation to any cancellation, postponement or change of venue shall be limited to the price paid by you for the workshop or session and we shall not be liable under any circumstances for any consequential losses.

5. Your obligations

If you or any young people attending the workshop act in any way which in our opinion is likely to cause any harm or nuisance to any person at the workshop or our staff, you may be required to leave the workshop and we shall not be liable to refund your fee or any other payment.

You and young people attending the workshop must comply at all times with the health and safety policy of the venue. You and young people attending the workshop must comply with all requests from us about health and safety and failure to do so will result in you being asked to leave the workshop (in which case no refund will be provided). You may not bring any equipment or items of a hazardous or dangerous nature to the workshop.

You and young people attending the workshop shall not cause any damage to any part of the venue (including outside areas, and all inside walls, flooring, fixtures and fittings). You are solely liable for any damage caused by you, your employees, contractors, sub-contractors, agents and young people to any such area of the venue and shall fully reimburse us in relation to any damage so caused.

You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to the workshop by you.

6. Materials at the workshop

Unless otherwise stated, the copyright for any materials used at the workshop, including all displays, audio visual content, worksheets, slides, brochures, articles and case studies, belongs to us and may not be reproduced in any medium without our prior written consent.

We reserve the right to change the published programme or materials as we think fit.

7. Photography and filming

We may wish to photograph or film the workshop for the purposes of promoting future workshops or otherwise. In such cases, we will write to you to obtain your written consent. By ticking ‘Yes’ to permission to use photos or video for marketing purposes in any booking form, you automatically consent to this and we will not also need to obtain written consent.

You may not photograph or video the workshop. If you wish to obtain any photos or videos recorded by BCE you must make a request to us by emailing office@beyondcreativeeducation.org.

8. Data protection

We will communicate with you using the contact details provided at booking for the purposes of the workshop. You agree that we may send your personal data outside of the European Economic Area (for example to the providers of our CRM system).

9. Disability and medical conditions

If you or any of the young people attending the workshop have any disability or medical condition that requires us to make special arrangements for you, please email us at office@beyondcreativeeducation.org as soon as possible. 

10. Warranties and Liabilities

The Supplier warrants to the Client that the Specified Service will be provided using reasonable care and skill.

Except in respect of personal injury caused by the Supplier’s negligence, or as expressly provided in these conditions the Supplier shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Supplier, its servants or agents or otherwise) which arise out of or in connection with the provision of the service or their use by the Client, and the entire liability of the Supplier under or in connection with the Contract shall not exceed the amount of the Supplier’s fee and charges for the provision of the service, except as expressly provided in these conditions.

The Supplier shall not be liable to the Client or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Supplier’s obligations in relation to the service, if the delay or failure was due to any cause beyond the Suppliers reasonable control.

11. Special Conditions

The following Special Conditions apply to the following named Specified Services

  1. Workshops are for a maximum of 16 children and a minimum of 4 children, the Supplier reserves the right to cancel the Workshop without reimbursement if these maximum and minimum numbers are not met by the Client.

  2. The Client agrees to these Terms and Conditions by emailing specific details of the sessions

  3. If the Supplier is delivering sessions off-site, it is the responsibility of the Client to identify and provide an appropriate space for the Supplier to deliver the Workshop. Such space should be large enough to accommodate all the children taking part in the Workshop in one room

  4. If the Supplier is delivering sessions off-site the client must ensure that there is at least one nominated representative of the Client in the session at all times during the delivery of the Workshop and until all the children and/or young people have left the Workshop

  5. If the Supplier is delivering sessions off-site the client must ensure any relevant first aid that is required for the Workshop is available;

  6. If the Supplier is delivering sessions off-site the client will accept all responsibility and fulfil all legal requirements that may be relevant to a Workshop.

  7. If the Supplier is delivering sessions off-site the client must return any details regarding topics and timings related to the Workshop. Failure to do so will result in default topics and timings being selected by the Supplier
